Gates County eRecording

Gates County now accepts eRecording for all documents. Electronic recording allows attorneys, title companies, and other filers to submit deeds, deeds of trust, and other instruments without visiting the courthouse. The system follows the standards set by the North Carolina Secretary of State and the Electronic Recording Council.

Under the Uniform Real Property Electronic Recording Act, an electronic document satisfies the requirement for an original paper document. An electronic signature meets the signature requirement. Even notarization can be done electronically if the notary's electronic signature and required information are attached to the document.

Recording Deeds in Gates County

All deeds filed in Gates County must meet format rules under G.S. 161-14. Paper must be 8.5 by 11 or 8.5 by 14 inches. The first page needs a 3-inch top margin. Other margins must be at least half an inch. Text must be in black ink on white paper at 9 points or larger. The instrument type must be stated at the top of the first page.

Fees follow the statewide schedule. A deed costs $26 for the first 15 pages, plus $4 per extra page. Deeds of trust and mortgages cost $64 for the first 35 pages. Nonstandard documents add $25. The NCARD fees page has the full list.

The drafter's name must be on the first page for deeds after January 1, 1980. Each deed must be signed, notarized, and acknowledged. Under G.S. 47-14, the register will not accept a document without proof of execution.

Gates County Deed Priority

Under the Conner Act, G.S. 47-18, the person who records a deed first at the Gates County Register of Deeds holds the legal claim. North Carolina is a race to record state. A deed that is not recorded cannot stand against a later buyer who files first.

The register stamps each document with the day and hour it was filed. If two documents are filed at the same time, the one with the lower document number takes priority. This rule protects buyers and lenders in Gates County.
