Types of Halifax County Deed Records

Recording Fees in Halifax County

Halifax County follows the statewide fee schedule for recording. Under G.S. 161-10, most instruments cost $26 for the first 15 pages and $4 per page after that. Deeds of trust and mortgages are $64 for the first 35 pages plus $4 per extra page. Nonstandard documents incur an extra $25 charge.

The excise tax on property conveyances applies in Halifax County. Under G.S. 105-228.30, the rate is $1 per $500 of the sale price. The seller pays this to the register before the deed is recorded. Halifax County Document Format Rules

All documents recorded in Halifax County must meet state standards. G.S. 161-14 sets the rules. Paper size must be 8.5 by 11 inches or 8.5 by 14 inches. The first page needs a 3-inch top margin. Other margins must be at least half an inch. Use black ink on white paper. Font size must be 9 points or larger.

Print on one side of each page. State the instrument type at the top. Deeds executed after January 1, 1980, must show the drafter's name on the first page per G.S. 47-17.1. Documents that fail these standards get a $25 surcharge.

How to Record a Deed in Halifax County

Start by preparing your deed. The grantor must sign it. A notary or other authorized officer must acknowledge the signature. This requirement comes from G.S. 47-14. The document must meet all format rules before the register will accept it.
