Graham County Recording Fees
Graham County posts its own fee schedule, which follows state law. Land records instruments, except deeds of trust, cost $26 for the first 15 pages and $4 for each page after that. Deeds of trust and mortgages cost $26 for the first 35 pages, a rate amended on October 1, 2016. Marriage licenses cost $60, effective since September 1, 2009.

Graham County Deed Filing Rules
All deeds filed in Graham County must meet the format rules in G.S. 161-14. Paper must be 8.5 by 11 or 8.5 by 14 inches. The first page needs a 3-inch top margin. Other margins must be half an inch or more. Text must be in black ink on white paper in a font of 9 points or more. Only one side of each page may have text. The type of instrument must appear at the top of the first page.
The drafter's name is required on the first page for deeds after January 1, 1980, per G.S. 47-17.1. Each deed must be signed and notarized. The register will not accept a document without proper acknowledgment.
Graham County and the Conner Act
North Carolina is a race to record state. The Conner Act, G.S. 47-18, says that no deed is valid against a later buyer who records first. In Graham County, the person who files at the Register of Deeds first holds the legal claim to the land.
Priority depends on the time stamp placed by the register. If two instruments arrive at the same time, the lower document number wins. This rule covers deeds, options to purchase, leases over three years, and rights of first refusal. Filing quickly after a land deal closes is the safest step you can take.

Excise Tax in Graham County
When property is sold in Graham County, the seller must pay an excise tax before the deed is recorded. Under G.S. 105-228.30, the rate is $1 for every $500 of the sale price. Timber deeds carry the same tax. If the property crosses county lines, the tax goes to the county with the larger share of value.
Graham County may also require tax certification before recording. Under G.S. 161-31, the county can ask the tax collector to confirm no delinquent taxes exist on the property. A closing attorney can include a statement about paying any back taxes from closing funds to bypass this step.
