Greensboro Deed Filing Fees

Greensboro Deed Priority Rules

North Carolina is a "race to record" state under the Conner Act. G.S. 47-18 says no conveyance of land is valid against a buyer for value until it is registered in the county where the land lies. For Greensboro, that is Guilford County. The first party to record a deed holds legal priority over all later claimants.

Instruments registered at the Guilford County office have priority based on the order of registration. The timestamp on each document determines its place. If two instruments are filed at the same time, the earliest document number has priority. When no document number exists, the book and page number controls. Greensboro property buyers should ensure their attorney records the deed right after closing.

Greensboro Deed Format Standards

Every Greensboro deed must meet the format rules in G.S. 161-14 before the county will accept it. Paper must be 8.5 by 11 inches or 8.5 by 14 inches. The first page requires a three-inch blank top margin. All other margins need at least half an inch. Text must be typed or printed in black on white paper using a font of at least 9 points.

Printing goes on one side of each page only. The instrument type must be at the top of page one. Deeds made after January 1, 1980, must name the drafter on the first page per G.S. 47-17.1. Greensboro Transfer Tax

An excise tax applies to each Greensboro deed that conveys property for value. Under G.S. 105-228.30, the rate is $1 for every $500 of the purchase price or any fraction of that amount. The seller pays this tax to the Guilford County Register of Deeds before the deed is recorded.

On a $280,000 Greensboro home, the excise tax would be $560. This tax also applies to timber deeds and contracts for standing timber. If a Greensboro parcel crosses county lines, the tax is paid in the county where the greater portion of the property value sits.
