Charlotte Deed Records System

Mecklenburg County operates the Polaris system for Charlotte property records. The Polaris Property Ownership and Land Records System allows users to search by address, owner name, or parcel number. The current version, Polaris v4.1, includes tools for situs address search, preliminary plan search, engineering grid search, and property analysis. This is the primary way to look up Charlotte deed records online.

The city of Charlotte at charlottenc.gov provides access to city council meetings, news, and local services. But it does not handle deed records. All Charlotte property filings go through the Mecklenburg County office. This is true for every city in North Carolina. State law gives county registers of deeds sole authority to record, preserve, and index land documents.

The Mecklenburg County government website has public notices, department listings, and service information. The register of deeds maintains full alphabetical indexes of all recorded instruments as required by G.S. 161-22. These indexes cover every Charlotte deed by grantor name, grantee name, and document type.

Charlotte Deed Filing Costs

Charlotte deed records follow the statewide fee schedule. Under G.S. 161-10, these are the recording fees:

  • Standard deed: $26 for the first 15 pages, $4 per added page
  • Deed of trust or mortgage: $64 for the first 35 pages, $4 per added page
  • Plat: $21 per sheet
  • Nonstandard document surcharge: $25
  • Multiple instruments as one document: $10 each
  • Satisfaction instruments: no fee

Charlotte Deed Priority Rules

North Carolina is a "race to record" state. The Conner Act at G.S. 47-18 controls priority for Charlotte deed records. No conveyance of land, contract to convey, option to purchase, or lease for more than three years is valid against a buyer for value until it is registered in the county where the land lies. For Charlotte, that is Mecklenburg County.

Instruments registered in the office of the register of deeds have priority based on the order of registration. The timestamp matters. If two instruments are filed at the same time, priority goes to the one with the earliest document number. If no document number exists, the sequential book and page number determines order. This system protects Charlotte property buyers who record their deeds promptly.

Recording priority applies to deeds, contracts, options, leases over three years, rights of first refusal, and rights of first offer. Any of these must be recorded to be valid against later creditors or buyers.

Charlotte Deed Format Standards

Every Charlotte deed must meet the format rules in G.S. 161-14. Paper must be 8.5 by 11 inches or 8.5 by 14 inches. The first page needs a three-inch blank top margin. Other margins must be at least half an inch. Text must use black ink on white paper with a font of at least 9 points. Only one side of each page may have text.

The type of instrument goes at the top of the first page. Deeds executed after January 1, 1980, must name the drafter on page one. A document that fails these standards gets a $25 nonstandard surcharge. Charlotte Transfer Tax on Deeds

An excise tax applies to each Charlotte deed that conveys property for value. Under G.S. 105-228.30, the rate is $1 for every $500 of the sale price or fraction thereof. The seller pays this to the Mecklenburg County Register of Deeds before the deed is recorded.

On a $500,000 Charlotte home, the excise tax totals $1,000. This tax applies to all instruments that convey an interest in real property, including timber deeds. If a Charlotte parcel crosses county lines, the tax is paid in the county where the greater portion of the property value sits. The register stamps the deed after the tax is collected.
