Chapel Hill Deed Filing Process

To file a Chapel Hill deed, you bring the signed and notarized document to the Orange County Register of Deeds. The register checks that the deed meets all state requirements before accepting it. Chapel Hill Deed Recording Fees

Recording fees for Chapel Hill deed records are set by state law. Under G.S. 161-10, a standard deed costs $26 for the first 15 pages and $4 for each page beyond that. Deeds of trust and mortgages cost $64 for the first 35 pages with $4 per added page. The NCARD fee schedule has all the details.

Other fees include $21 per sheet for plats. Documents that fail to meet format standards get an extra $25 charge. Satisfaction instruments have no fee at all. Chapel Hill Deed Format Requirements

Every Chapel Hill deed must meet the format rules in G.S. 161-14 before the county will record it. The document must be on paper sized 8.5 by 11 inches or 8.5 by 14 inches. A three-inch blank margin is required at the top of the first page. All other margins need at least half an inch.

Text must be typed or printed in black ink on white paper. The font must be at least 9 points. Only one side of each page can have text. The type of instrument must appear at the top of page one. For deeds made after January 1, 1980, the drafter's name must be on the first page under G.S. 47-17.1.

Chapel Hill Excise Tax on Deeds

Every Chapel Hill deed that transfers property for value is subject to an excise tax. G.S. 105-228.30 sets the rate at $1 per $500 of the sale price or any fraction thereof. The seller pays this tax to the Orange County Register of Deeds before the deed can be recorded.

For a Chapel Hill home that sells for $350,000, the excise tax would be $700. This tax also applies to timber deeds. If a Chapel Hill parcel spans two counties, the tax is paid in the county where the greater share of the property value lies. The register of deeds collects the tax and stamps the deed to show it has been paid.

Electronic Recording in Chapel Hill
